Oklahoma Notaries Who Fail in Good Faith to Identify a Person Appearing Before Them May Face Penalties and Imprisonment


Starting on November 1, 2024, the Secretary of State may deny, refuse to renew, or revoke a notary public’s commission for Oklahoma notaries who do not comply in good faith with the requirements outlined in Section 113, Title 49 of the Oklahoma Statutes. In addition, notaries who do not identify the signer in good faith will be found guilty of a misdemeanor and be fined $1,000, imprisoned in county jail for no more than ten days, or both. These changes were enacted by Oklahoma Senate Bill 556, which was passed on April 30, 2024. The new requirements can be found in Sections 12 and 113, Title 49 of the Oklahoma Statutes.
